It is hereby clarified that some of the processing activities covered by this Privacy Policy also apply to Customers who physically visit the “VENEZIANICO ATELIER” store located at Corso Silvio Trentin 76, San Donà di Piave (VE): upon purchase of one of our products, we offer new Customers registration on the Shopify platform (the same used for online purchasers), also specifying that their e-mail address will be used for future e-mail marketing activities, as described in points 1.i and 2.

It is further clarified that this Website and the services possibly offered through it are reserved for individuals over the age of eighteen: the Data Controller does not, therefore, collect personal data relating to individuals under 18 years of age. In any case, upon specific request, the Data Controller will promptly delete any personal data inadvertently collected relating to individuals under the age of 18.

The Data Controller places the highest importance on the right to privacy and protection of the personal data of its Users: for any information regarding this privacy policy, Users may contact the Data Controller at any time, also using the methods described in point 5.

1. Purposes of the processing

The personal data of the Users will be lawfully processed by the Data Controller pursuant to Article 6 of the Regulation for the following purposes:

  1. Website navigation, in connection with the ability to collect User data required on a technical level (so-called technical cookies), such as the IP address, while browsing the site; regarding other cookies installed on our site, please consult the cookie policy available on our website.
  2. Sending newsletters or other promotional material to individuals who are not Customers, including the e-mail open tracking described in point 2 (in this case the legal basis for processing is the Data Subject’s consent, expressed through a single informed choice, GDPR Art. 6, para. 1, letter a).
  3. Responding to requests for information, received by the Data Controller via the contact form or by other means (e.g. phone or e-mail contact). (In this case the legal basis is the necessity to perform a request by the Data Subject, GDPR Art. 6, para. 1, letter b).
  4. Registration to the reserved area of the site (to monitor online purchases, order history, order status, etc.). (In this case the legal basis is the necessity to perform a request by the Data Subject, GDPR Art. 6, para. 1, letter b).
  5. Legal obligations, namely to comply with obligations imposed by laws, authorities, regulations or EU legislation. (In this case the legal basis is the necessity to comply with legal obligations, GDPR Art. 6, para. 1, letter c).
  6. Contractual obligations and service provision in the case of online or in-store purchases at Corso Silvio Trentin 76, San Donà di Piave (VE), to execute the General Terms and Conditions of Sale (accepted by the User at registration on the Website) and to respond, also through our customer care, to specific Customer requests. (In this case the legal basis is the necessity to perform the contract and respond to the Data Subject’s requests, GDPR Art. 6, para. 1, letter b).
  7. Contact regarding incomplete purchases, i.e. the User may be contacted via the e-mail address or phone number provided during navigation, registration or the beginning of the checkout process, in order to receive support in completing the purchase. The legal basis is the Data Controller’s legitimate interest in facilitating the completion of the purchasing process, pursuant to Art. 6, para. 1, letter f) of the GDPR. In case of use of the WhatsApp channel, contact will only occur if the Data Subject has previously provided their number for communication with the Data Controller. The Data Subject may object to this processing at any time.
  8. Administrative and accounting purposes, i.e. to perform organisational, administrative, financial and accounting activities functional to the fulfilment of contractual and pre-contractual obligations. (In this case the legal basis is the necessity to comply with legal obligations, GDPR Art. 6, para. 1, letter c).
  9. Sending “soft spam” commercial communications, i.e. the Data Controller will send commercial communications regarding products similar to those already purchased, to the e-mail addresses used for such purchases, including the e-mail open tracking described in point 2, as it is strictly connected to the sending of such communications. These communications are sent by e-mail only. (In this case the legal basis is the combined provision of Art. 130, paragraph 4 of Italian Legislative Decree 196/2003 as amended and Art. 6, para. 1, letter f of the GDPR – legitimate interest). The Data Subject may object at any time, when the address is collected and on the occasion of each communication, either to receiving the e-mails or to the open tracking alone.
  10. Klarna payment method. In order to offer the User/Customer Klarna’s payment methods, we may transmit their personal data to Klarna during checkout. The personal data transferred is processed in line with Klarna’s privacy policy. (In this case, by choosing this payment method, the User/Customer consents to the transmission of their personal data to Klarna).

2. E-mail open tracking

Promotional e-mails sent by the Data Controller for the purposes described in points 1.b and 1.i may contain images or other tools (so-called tracking pixels) that make it possible to detect whether and when a message is opened. Depending on the e-mail service used by the Data Subject, technical information may be collected, such as the IP address, the type of device or program used to read the e-mail, and the time and number of openings.

The Data Controller uses this information solely to improve its communications: to measure the response to messages and, where applicable, to decide whether to send a follow-up message, for example to those who did not open the previous one, as well as to identify inactive contacts. The Data Controller does not use open data to infer interests or preferences, nor to create profiles for advertising on other channels, and does not share such data with third-party advertising platforms.

The Data Subject may at any time:

  • stop the open tracking only, while continuing to receive promotional e-mails without such tools, via the “Manage preferences (open tracking)” link included in every message;
  • withdraw consent to, or object to, receiving promotional communications, via the “Unsubscribe” link included in every message;
  • exercise these choices also through the methods described in point 5.

The Data Controller records the Data Subject’s choice and applies it to subsequent communications within 72 hours.

3. Methods of processing and data retention periods

The Data Controller will process Users’ personal data using manual and IT tools, with logics strictly related to the purposes stated above and, in any case, in a way that ensures the security and confidentiality of the data.

Users’ personal data will be stored only as long as strictly necessary to fulfil the purposes listed in paragraph 1 above, or in any case as long as necessary for the protection under civil law of the interests of both the Users and the Data Controller. In relation to the purposes described in points 1.b and 1.i, data will be stored until the Data Subject withdraws consent or objects to receiving the communications, via the link contained in them or through the methods described in paragraph 5. Once the open tracking alone has been stopped, the Data Controller will no longer collect the related data.

4. Data communication and dissemination

The personal data of the Users may be accessed by the Data Controller’s employees and/or collaborators in charge of managing the Website and/or sales operations and/or customer care. These individuals, formally appointed by the Data Controller as “persons authorised to process personal data”, will process the Data Subjects’ data exclusively for the purposes stated in this privacy policy and in accordance with the Applicable Law.

Users’ personal data may also be accessed by third parties who process personal data on behalf of the Data Controller as “Data Processors”, such as, by way of example, providers of IT and logistics services, outsourcing or cloud computing service providers, providers of e-mail sending platforms, professionals and consultants. Data may also be communicated to the Tax Authority and/or other public authorities where required by law or upon their request.

Data Subjects have the right to obtain a list of the Data Processors appointed by the Data Controller, by submitting a request using the methods described in paragraph 5 below.

5. Data Subjects’ rights

Data Subjects may exercise the rights granted to them by the Applicable Law, including the right to request from the Data Controller access to their personal data, rectification or erasure of such data, restriction of processing or objection to processing, the right to withdraw their consent at any time, also partially (for example, limited to e-mail open tracking), without affecting the lawfulness of processing based on consent before its withdrawal, or the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali).

The Data Controller may be contacted using the following methods:

  • By sending a registered letter with return receipt to the Data Controller’s registered office
  • By sending an e-mail to info@venezianico.com
